Traveltalk Competition Terms and Conditions

1. Application of these terms

These general terms and conditions apply to all competitions conducted by Pointer Publishing Pty Ltd ABN 92 150 111 701 trading as Traveltalk Media (“Promoter”).

Each competition will also have Competition Specific Terms setting out details including how to enter, the competition period, eligibility requirements, the prize, judging criteria and judging date. The Competition Specific Terms form part of these terms and conditions.

By entering a competition, entrants agree to be bound by these general terms and conditions and the Competition Specific Terms.

If there is any inconsistency between these general terms and conditions and the Competition Specific Terms, the Competition Specific Terms will apply to the extent of the inconsistency.

Additional conditions imposed by the organisation supplying the prize (“Prize Supplier”) will also apply where they are included in or provided with the Competition Specific Terms.

The Promoter is Pointer Publishing Pty Ltd trading as Traveltalk Media, of 24 Chandos Street, Manly Vale NSW 2093.

2. Eligibility

Entry is open only to Australian residents aged 18 years or over unless otherwise stated in the Competition Specific Terms.

Employees and directors of the Promoter or Prize Supplier, their immediate family members and employees of agencies or companies directly associated with the competition are not eligible to enter.

For the purposes of these terms, “immediate family” includes a spouse, de facto partner, parent, child or sibling, whether or not they live in the same household.

Entrants must enter in their own name.

Only one entry per person is permitted in each competition unless otherwise stated in the Competition Specific Terms.

The Promoter may require an entrant or winner to provide reasonable proof of identity, age, Australian residency and entry validity.

Any proof provided must be reasonably acceptable to the Promoter. If a winner cannot provide the requested proof within the required period, the Promoter may declare the prize forfeited and award it to the next highest ranked eligible entrant.

3. Competition period

The competition opens and closes on the dates and at the times stated in the Competition Specific Terms.

Unless otherwise specified, all dates and times are based on the local time in Sydney, NSW.

Entries must be received by the Promoter before the stated closing time. Entries received after that time will not be accepted.

The Promoter is not responsible for entries that are delayed, misdirected, incomplete or not received because of a technical failure or other circumstance outside the Promoter’s reasonable control.

4. How to enter

Entrants must follow the entry method and instructions stated in the Competition Specific Terms.

Entrants must correctly answer any multiple choice or eligibility questions and provide any written or tie-break response required by the Competition Specific Terms.

Only entries containing the correct answer or answers to all required multiple choice questions will be eligible for judging, unless the Competition Specific Terms provide for a different scoring method.

Entries must comply with any applicable word limits, formatting requirements and other entry instructions.

No purchase is necessary unless expressly stated in the Competition Specific Terms.

5. Unsolicited correspondence and materials

Only information submitted through the official competition entry method will be considered by the judges.

Entrants must not post, courier or personally deliver letters, parcels, gifts, promotional materials or other physical items to Traveltalk Media, the Promoter, its employees or the judges in connection with a competition.

Any additional correspondence or physical items will not form part of the entry or judging process and will not improve an entrant’s prospects of winning. Items received may not be acknowledged, retained or returned.

6. Entry validity

Entries must be complete, comprehensible and submitted in accordance with these general terms and conditions and the Competition Specific Terms.

The Promoter may disqualify an entry or entrant if it reasonably believes that:

  • the entry is incomplete, incomprehensible or submitted after the closing time;
  • the entry contains unlawful, defamatory, discriminatory, offensive or inappropriate material;
  • the entry contains profanity or material that is insulting, inflammatory or potentially damaging to another person;
  • the entry infringes another person’s copyright, privacy or other rights;
  • the entrant has submitted more entries than permitted;
  • the entrant has used multiple names, email addresses, residential addresses or other identifying details to avoid the entry limit;
  • the entrant has used automated entry software or manipulated or interfered with the entry process;
  • the entry contains false, misleading or deceptive information;
  • the entrant is not eligible to enter; or
  • the entrant has engaged in fraud, cheating or conduct likely to damage the competition, Promoter or Prize Supplier.

Minor errors in an entrant’s contact details will not automatically invalidate an entry. However, an entry may be invalidated if the Promoter cannot reasonably identify or contact the entrant using the information provided.

The Promoter may disqualify a winner if grounds for disqualification are discovered after the winner has been selected.

7. Games of skill

All Traveltalk competitions are games of skill. Chance plays no part in determining a winner.

Eligible entries will be judged individually according to the criteria stated in the Competition Specific Terms.

Unless otherwise specified, written responses will be judged on:

  • originality;
  • creativity;
  • relevance to the competition question; and
  • any additional criterion stated in the Competition Specific Terms, such as humour.

Where entrants are required to answer multiple choice questions, the number of correct answers may form part of the judging criteria. If entrants achieve the same score, the winner will be determined using a written or other skill based tie-break response specified in the Competition Specific Terms.

The entry judged to be the best overall response will be selected as the winner.

If two or more entries are judged equally, the judges will reassess those entries against the same criteria and select the strongest overall entry. A winner will not be selected randomly.

Judging will take place on the date and at the location stated in the Competition Specific Terms.

The judges’ decision is final, subject to applicable law, and no correspondence will be entered into concerning the result.

8. Winner notification

The Promoter will make reasonable efforts to contact the winner using the details supplied with the entry.

The winner must respond and provide any requested information or verification within 10 days of being notified, unless another period is stated in the Competition Specific Terms.

If the winner:

  • cannot be contacted after reasonable efforts;
  • does not respond within the required period;
  • does not provide the required verification;
  • is found to be ineligible;
  • has breached these terms; or
  • is unable or unwilling to accept the prize,

the prize will be forfeited and the judges may award it to the next highest ranked eligible entry.

The replacement winner will be contacted using the details supplied with their entry and must comply with the same verification and acceptance requirements.

9. Winner announcement and publicity

The winner’s name and state or territory may be published in Traveltalk’s newsletter, on Traveltalk’s website and social media channels and in reasonable publicity undertaken by the Promoter or Prize Supplier.

By accepting a prize, the winner agrees to participate in reasonable competition related publicity without additional payment. This may include providing a photograph or participating in an interview, provided any such requirement is reasonable and disclosed to the winner.

The Promoter will not publish a winner’s residential address, personal phone number, private email address or other private contact information.

10. Prizes

The prize and its inclusions and exclusions will be described in the Competition Specific Terms. Where a prize value is stated, it is based on information provided by the Prize Supplier and is correct at the time the competition begins.

The prize is subject to any conditions imposed by the Prize Supplier.

Unless otherwise stated in the Competition Specific Terms:

  • the prize is not transferable, exchangeable or redeemable for cash;
  • the prize cannot be sold or otherwise transferred to another person;
  • the winner is responsible for all costs not expressly included in the prize;
  • the prize is subject to availability, validity periods, booking requirements, blackout dates and other disclosed restrictions;
  • the Promoter is not responsible for any change in the value of the prize; and
  • the winner must comply with the reasonable requirements of the Prize Supplier.

If the prize or part of the prize becomes unavailable for reasons beyond the Promoter’s reasonable control, the Promoter may, where permitted by law, provide a prize of reasonably equivalent nature and value.

Nothing in these terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, restricted or modified, including rights under the Australian Consumer Law.

11. Travel prizes

Where a prize includes travel, the winner and any travelling companion must satisfy all eligibility and travel requirements stated in the Competition Specific Terms or imposed by the Prize Supplier.

Unless expressly included in the prize description, the following are not included:

  • airfares;
  • accommodation;
  • airport or other transfers;
  • meals and beverages;
  • travel insurance;
  • passports and visas;
  • vaccinations or other health requirements;
  • baggage charges;
  • taxes and fees;
  • spending money; and
  • incidental or personal expenses.

The winner and any travelling companion are responsible for obtaining and maintaining valid passports, visas, travel insurance, health documentation and any other documents required for the journey.

The winner and any travelling companion must travel together on the dates and itinerary required by the Prize Supplier.

If the winner cannot travel on the required dates, the prize may be forfeited unless the Prize Supplier agrees to alternative arrangements.

The winner is responsible for determining whether the travel is suitable for their personal circumstances and for complying with all relevant health, immigration, security and entry requirements.

Any travelling companion may be required to sign a release or comply with additional conditions before travelling.

12. Physical prize delivery

Where a physical prize is to be delivered, the winner must provide accurate and complete delivery information.

The Promoter will take reasonable steps to arrange delivery but is not responsible for loss, theft or damage occurring after the prize has been delivered to the address nominated by the winner, except to the extent caused by the Promoter’s negligence or where liability cannot lawfully be excluded.

If a prize cannot be delivered because the winner provided incorrect or incomplete information, the winner may be responsible for any reasonable redelivery costs.

13. Ownership and use of entries

Entrants retain ownership of copyright in their entries.

By entering, each entrant grants the Promoter and Prize Supplier a non-exclusive, worldwide, royalty-free licence to reproduce, publish, edit, adapt and communicate their entry for the purposes of:

  • administering and judging the competition;
  • announcing and publicising the winner;
  • promoting the competition and its outcome; and
  • promoting future Traveltalk competitions.

This licence does not permit the Promoter or Prize Supplier to sell an entrant’s entry as a standalone commercial product.

Entrants warrant that their entry:

  • is their original work;
  • does not infringe another person’s copyright, privacy or other rights;
  • does not contain material used without permission; and
  • may lawfully be used as permitted by these terms.

14. Privacy

The Promoter will collect and use entrants’ personal information to:

  • administer and judge the competition;
  • verify eligibility;
  • contact entrants and winners;
  • announce the winner;
  • arrange and deliver the prize; and
  • undertake any other use disclosed when the information is collected.

The Promoter may provide a winner’s personal information to the Prize Supplier and relevant service providers where reasonably necessary to verify, organise or deliver the prize.

The Prize Supplier may have its own privacy policy and may require additional personal information from the winner to arrange or provide the prize.

Personal information will otherwise be handled in accordance with Traveltalk Media’s privacy policy.

15. Traveltalk subscription

Entry is open only to Traveltalk subscribers unless otherwise stated in the Competition Specific Terms.

By entering and providing the required consent, entrants agree to subscribe to and receive Traveltalk’s newsletter and other communications described on the entry form.

Entrants must be subscribed to Traveltalk’s newsletter on the judging date to be eligible to win.

Traveltalk marketing emails will identify the sender and include a facility through which recipients can unsubscribe.

16. Technical problems and events beyond the Promoter’s control

If a competition cannot be conducted as planned because of fraud, technical failure, unlawful interference, natural disaster, government restriction or another event beyond the Promoter’s reasonable control, the Promoter may suspend, modify or cancel the competition, subject to applicable law.

The Promoter may amend these terms where reasonably necessary to:

  • correct an error;
  • clarify an ambiguity;
  • comply with the law;
  • protect the integrity of the competition; or
  • respond to circumstances beyond its reasonable control.

Any material amendment will be communicated using the same channels through which the competition was promoted and will not unfairly disadvantage entrants who entered before the amendment.

17. Liability

To the maximum extent permitted by law, the Promoter is not responsible for any loss, damage, injury, expense or disappointment suffered in connection with entering the competition or accepting or using a prize, except where caused by the Promoter’s negligence or wilful misconduct.

The Promoter is not responsible for the acts, omissions, cancellation, delay or failure of the Prize Supplier or another third party, except where the Promoter is legally responsible for that conduct.

Entrants and winners are responsible for assessing the suitability and risks of accepting and using a prize.

Nothing in these terms excludes, restricts or modifies any guarantee, warranty, right or remedy that cannot lawfully be excluded, restricted or modified.

18. Social media

Where a competition is advertised or promoted through Facebook, Instagram or another social media platform, the competition is not sponsored, endorsed, administered by or associated with that platform unless expressly stated otherwise.

Entrants agree to comply with the applicable platform’s terms of use.

To the extent permitted by law, entrants release the relevant social media platform from claims arising from or connected with the competition.
